Restauranteur's Modern Cusine Fused with Dalina's
Legal Acumen is a Recipe for Trademark Success

When Chef Richard Sandoval set out to change the way people perceive Mexican food by reinterpreting traditional Mexican flavors into a delightful blend of modern cuisine his culinary mission was clear. Sandoval's goal was to "share true Mexican cuisine with Americans" while showcasing the "breadth of Mexican ingredients and creativity." To achieve the goal meant establishing a brand synonymous with the modern yet traditional flair of his cuisine.

Dalina attorneys were called on to protect the trademarks identities that are now synonymous with Sandoval's cuisine. Each of Sandoval's numerous restaurants are backed by a comprehensive trademark strategy designed for Sandoval to expand his restaurants as needed.

Registered Trademarks Include:

Operating under the goal of establishing Sandoval at the helm of Mexican food evolvement into modern cusine Dalina's execution of a registration and enforcement program was closely aligned with Sandoval's overarching company goals. Everything from oppositions to federal court actions for trademark infringement have been a component of maintaining the trademarks closely associated with Sandoval's creative flair.

As is the case with any enforcement strategy litigation is sometimes required. In Modern Mexican Restaurants v. Maya Lounge Dalina sought a permanent injunction against another New York restaurant operating under the name Maya Lounge. Federal District Judge Cooper agreed with the arguments presented by Dalina attorneys, issued the injunction prohibiting infringing uses of the Maya name and awarded payment of attorneys fees for prosecuting the trademark infringement action.

Result = Numerous Trademarks Registered, Trademark Oppositions resolved, Federal Actions for Trademark Infringement Won.
